Professional fees for attorney and alternative dispute resolution services are negotiated on a case-by-case
basis.  Mr. Rundle believes that the "one size fits all" approach long used by large law firms in setting
professional hourly rates does not properly address a client's needs.  While some cases are properly handled
on the basis of an hourly fee arrangement, many other matters are well suited to alternative billing
arrangements such as:

  • Flat Fee

  • Capped Fee

  • Contingent Fee

  • Partial Contingent Fee

Some factors that are considered in determining what fee structure is best suited to a particular matter are:

  • Does the matter involve litigation, ADR or transactional needs?

  • How complex is the matter (number of parties; amount in controversy; venue)?

  • Are professional services sought at the outset of the matter, or do time constraints exist?

  • Does the potential client have unique financial needs?
